ABSTRACT


This study examined the effects of international law and state sovereignty on the resolution of the Nigeria-Cameroon boundary dispute, with particular attention to the roles of international law, sovereignty claims, the International Court of Justice, diplomatic negotiations, and challenges affecting boundary resolution. The study was motivated by the need to know how a long-standing territorial dispute involving sovereignty and national interests was resolved through international law and peaceful mechanisms. The study adopted a descriptive survey design. Data were collected through structured questionnaires administered to 150 respondents, including government officials, security personnel, legal practitioners, academics, traditional leaders, and residents of relevant boundary communities in Cross River State. Secondary information was obtained from relevant books, journals, legal documents, and official records.

The findings showed that 76.7% of respondents agreed that international law affected dispute resolution, while 76.7% agreed that sovereignty claims had an effect. Furthermore, 80.0% agreed that the ICJ played a significant role, 76.7% supported the contribution of diplomacy and mediation, and 79.3% agreed that boundary-resolution challenges affected the process. Chi-square tests of 85.53, 84.87, 104.73, 85.13, and 97.93, respectively, exceeded the critical value of 9.488. The outcome of this research indicates that international law and state sovereignty significantly influenced the resolution of the Nigeria-Cameroon boundary dispute. The findings further show that judicial settlement, diplomatic negotiations, and mediation were important in translating the legal decision into practical resolution. The study concludes that effective boundary settlement requires legal, diplomatic, and cooperative approaches working together.



1.1 Introduction

International law refers to the rules and principles that regulate relationships among states and other recognized international actors. State sovereignty, on the other hand, refers to the authority of a state to exercise control over its territory and make decisions without external interference. These two principles are important in resolving international disputes because states are expected to respect international legal obligations while protecting their territorial interests (Shaw, 2017).

The Nigeria-Cameroon boundary dispute is a long-standing territorial disagreement involving areas along the border between both countries, particularly the Bakassi Peninsula. The dispute was influenced by colonial-era boundary arrangements, competing territorial claims, and concerns over control of land and maritime resources. Nigeria and Cameroon pursued different positions concerning ownership and sovereignty over the disputed territory, making the issue a significant matter of international relations in Africa.

The dispute was brought before the International Court of Justice, which delivered its judgment on 10 October 2002 and determined the sovereignty of the Bakassi Peninsula in favour of Cameroon. The Court also addressed the land and maritime boundary between the two countries and required both states to respect the established boundary (International Court of Justice, 2002).

As a prelude to other parts of this study, this chapter will discuss the background upon which this study was initiated, the statement of problems that led to this study, the aim and objectives of the study. 1.2 Background of Study

Historically, the Nigeria-Cameroon boundary dispute is closely connected to the colonial division of Africa and the boundary agreements made by European powers. According to Babatola (2012), the modern boundary between Nigeria and Cameroon was largely shaped during the colonial period when Britain and Germany established territorial arrangements in the region. Germany controlled Kamerun, while Britain administered territories that later became part of Nigeria. The Anglo-German Agreement of 11 March 1913 became particularly important because it defined the boundary around the Bakassi Peninsula. Thirlway (2013) stated that the later dispute involved different interpretations of these colonial agreements and the legal meaning of earlier British arrangements with the rulers of Old Calabar.

Babatola (2012) reported that the boundaries inherited by African states at independence created several territorial and cross-border problems because colonial authorities divided communities and territories according to European political interests. The Nigeria-Cameroon boundary reflects this historical situation. The boundary stretches from the Lake Chad region in the north to the Atlantic coast in the south, passing through areas where communities have maintained social and economic relationships across the border. Consequently, disagreements over the interpretation and application of colonial boundary agreements became an important source of tension between Nigeria and Cameroon.

The Nigeria-Cameroon boundary dispute became particularly serious over the Bakassi Peninsula. Akinyemi (2014) articulated that the dispute was influenced by competing territorial interests and the strategic importance of the border area. Bakassi attracted considerable attention because of its location, maritime significance, fishing activities, and perceived natural-resource value. Furthermore, the dispute involved different interpretations of historical agreements concluded during the colonial period. Cameroon relied strongly on the Anglo-German Agreement of 11 March 1913 and other boundary instruments, while Nigeria advanced arguments relating to administration, occupation, historical activities, and its understanding of previous arrangements.

The dispute eventually reached the International Court of Justice (ICJ). Cameroon instituted proceedings against Nigeria on 29 March 1994, asking the Court to determine sovereignty over Bakassi and to establish the maritime boundary between the two countries. According to the International Court of Justice (2002), the Court examined various historical treaties and boundary instruments, including the Thomson-Marchand Declaration of 1929-1930, the Henderson-Fleuriau Exchange of Notes of 1931, and the Anglo-German Agreements of 1913. The Court's consideration of these instruments showed the importance of treaty law and the principle of respect for inherited colonial boundaries in determining territorial ownership. In the same vein, Anyu (2007) asserted that the Bakassi case demonstrated the growing importance of judicial settlement in managing territorial conflicts in Africa.

On 10 October 2002, the ICJ delivered its judgment and determined the course of the land and maritime boundary between Nigeria and Cameroon. The Court held that sovereignty over the Bakassi Peninsula belonged to Cameroon and directed Nigeria to withdraw its administration and military or police forces from territories placed under Cameroonian sovereignty. Correspondingly, Cameroon was also required to withdraw its personnel from Nigerian territory identified by the judgment. The decision was legally binding on both parties and represented a major application of international law to an African territorial dispute.

The ICJ judgment also created an important question concerning the relationship between international law and state sovereignty. Nigeria had to accept a decision that affected its claim to territory and required the transfer of administrative control over Bakassi. Supporting this position, Nwokolo (2020) reported that Nigeria's decision to comply with the ICJ ruling helped prevent the dispute from developing into a more serious interstate conflict. The Nigerian response demonstrated that respect for international legal obligations may require a state to limit the exercise of its territorial claims in favour of a legally determined settlement. At the same time, the case showed that sovereignty remains significant because the implementation of a judgment depends largely on the willingness of states to cooperate.

This study is set against the backdrop of the need to examine how international law and state sovereignty have influenced the resolution of the Nigeria-Cameroon boundary dispute and the broader implications of the settlement for peaceful management of territorial conflicts.


1.3 Statement of Problems

Investigation revealed that the Nigeria-Cameroon boundary dispute has remained a major territorial and diplomatic issue, particularly over the Bakassi Peninsula. International law provides principles for resolving territorial disputes, while the sovereignty of states protects their authority over their territories. Additionally, the transfer of Bakassi to Cameroon following the 2002 judgment of the International Court of Justice raised concerns about sovereignty, territorial control, and the interests of affected communities (International Court of Justice, 2002).

Furthermore, the dispute shows that resolving a boundary conflict is not only a matter of applying international law but also of managing the sovereignty concerns of the states involved. On the other hand, differences in historical claims, political interests, security concerns, and the welfare of border communities have made the implementation of legal decisions more difficult. It is against this backdrop that this study seeks to examine the effects of international law and state's sovereignty on the resolution of the Nigeria-Cameroon boundary dispute.


1.4 Aim and Objectives of Study

The aim of this study is to examine the effects of international law and state sovereignty on the resolution of the Nigeria-Cameroon boundary dispute.

The specific objectives of this research are to:

  1. Examine the role of international law in the resolution of the Nigeria-Cameroon boundary dispute.
  2. Assess the effect of state sovereignty on Nigeria's response to the resolution of the boundary dispute.
  3. Examine the role of diplomatic negotiations in implementing the resolution of the boundary dispute.
  4. Assess the effects of the boundary resolution on the security and welfare of affected border communities.
  5. Examine the challenges associated with implementing international legal decisions in the Nigeria-Cameroon boundary dispute.

1.5 Research Questions

The study came up with research questions so as to be able to ascertain the above stated objectives. The specific research questions for the study are stated below as follows:

1.6 Research Hypotheses

In order to pursue the objective of this study, the following generalized statements have been designed to guide and aids in obtaining the result for the experiment to be conducted. For this work, the null hypothesis will be represented with H0 while the alternative hypothesis will be represented with hypothesis H1.

Hypothesis One

  • H0: International law has no significant effect on the resolution of the Nigeria-Cameroon boundary dispute.
  • H1: International law has a significant effect on the resolution of the Nigeria-Cameroon boundary dispute.

Hypothesis Two

  • H0: State sovereignty has no significant effect on Nigeria's response to the resolution of the Nigeria-Cameroon boundary dispute.
  • H1: State sovereignty has a significant effect on Nigeria's response to the resolution of the Nigeria-Cameroon boundary dispute.

Hypothesis Three

  • H0: Diplomatic negotiations have no significant effect on the implementation of the resolution of the Nigeria-Cameroon boundary dispute.

1.7 Significance of Study

The outcome of this research will provide government authorities with useful information on managing territorial disputes while respecting international legal obligations and national interests. The study will also help security agencies understand the security implications of boundary changes and improve attention to affected border areas.

Furthermore, the findings will provide communities with clearer information about the effects of boundary decisions on territory, movement, security, and local activities. It will also provide policy makers with information for developing better approaches to future boundary negotiations and international disputes.

Lastly, the study will provide a useful academic reference for researchers and students studying international law, sovereignty, diplomacy, and African boundary disputes.


1.8 Scope and Limitations of the Study

The study covers the Nigeria-Cameroon boundary dispute with particular attention to Cross River State. It examines the legal, political, diplomatic, security, and community aspects of the dispute.

The study is limited to information relevant to Nigeria's experience and does not examine every African boundary dispute. The study also focuses on the relationship between international law and sovereignty rather than providing a detailed legal analysis of every treaty connected with the boundary.


1.9 Definition of Terms

International Law:

International law refers to the rules and principles that govern relationships among states and guide the peaceful settlement of disputes. According to Brownlie (2008), international law provides rules that regulate relations among states and establish legal methods for addressing international disagreements.

State Sovereignty:

State sovereignty refers to the supreme authority of a state over its territory, government, and internal affairs. Shaw (2017) stated that sovereignty is a fundamental principle of the international legal system because states exercise authority over their territories and populations.

Boundary Dispute:

A boundary dispute is a disagreement between states concerning the location, ownership, or control of a particular territory. According to Prescott and Triggs (2008), boundary disputes often arise from differences over the interpretation of treaties, historical claims, or the physical location of territorial limits.

Nigeria-Cameroon Boundary Dispute:

This refers to the long-standing disagreement between Nigeria and Cameroon over parts of their common land and maritime boundary, particularly the Bakassi Peninsula. The International Court of Justice (2002) determined the boundary and held that sovereignty over Bakassi belonged to Cameroon.

Bakassi Peninsula:

The Bakassi Peninsula is a coastal territory located in the Gulf of Guinea that became the major focus of the Nigeria-Cameroon territorial dispute. The International Court of Justice (2002) determined that the territory belonged to Cameroon under the applicable international legal instruments.
