1.1 Introduction
The tendering system in public sector procurement is a structured process through which government entities invite, evaluate, and award contracts for goods, services, or works to suppliers and contractors. Tendering is generally defined as a formal and competitive procedure designed to ensure fairness, transparency, and value for money in public spending (Thai, 2009). Public sector procurement involves the acquisition of goods, services, and works using public funds. It is governed by policies, laws, and regulations that are intended to standardize procedures and ensure that procurement activities meet established objectives (OECD, 2016). In many developing countries, including Nigeria, the Public Procurement Act provides the legal framework for conducting procurement through competitive tendering, specifying requirements for transparency, eligibility, and evaluation criteria.
As a prelude to other parts of this study, this chapter will discuss the background upon which this study was initiated, the statement of problems that led to this study, the Aim and Objectives of the study. Others are significance of the study, scope of work, research hypothesis and questions, limitation of the study and definition of terms.
1.2 Background of Study
The tendering system is a pivotal component of public sector procurement, as it provides a formalized and structured process for acquiring goods, services, and works using public funds. According to Thai (2009), tendering is defined as a competitive procedure through which public institutions invite bids, evaluate proposals, and award contracts based on pre-established criteria to ensure fairness, transparency, and value for money. The essence of tendering is to mitigate favoritism, corruption, and inefficiency in the management of public resources. It is widely recognized that an effective tendering system is crucial for the achievement of economic and social development objectives, particularly in developing countries where public resources are limited and accountability mechanisms are often weak.
Public sector procurement is a complex function that involves multiple stakeholders, including procurement officers, regulatory authorities, contractors, and the general public. Reported by the World Bank (2016) is the assertion that inefficiencies in procurement processes contribute to increased project costs, delayed service delivery, and wastage of resources. The public sector, therefore, relies heavily on tendering procedures to standardize procurement practices, ensure competitive bidding, and facilitate the delivery of quality goods and services. It is stated that countries with well-structured procurement systems benefit from improved efficiency, reduced corruption, and enhanced public confidence in government operations (OECD, 2016).
Thai (2009) affirmed that these malpractices undermine the fundamental objectives of tendering, resulting in inflated contract costs, incomplete projects, and compromised service delivery. It is contended that weaknesses in procurement oversight and enforcement exacerbate the problem, as regulatory bodies often lack the capacity or authority to sanction non-compliant actors effectively. The resulting environment allows unethical practices to flourish, which negatively impacts the efficiency and credibility of public sector procurement.
Delays in tendering processes represent another critical challenge. According to the World Bank (2016), prolonged procurement cycles arise from bureaucratic procedures, excessive documentation requirements, and slow approval mechanisms. These delays discourage qualified contractors from participating in bids, increase project costs, and ultimately hinder the timely execution of public sector projects. Reported that insufficient capacity of procurement personnel and weak internal controls contribute significantly to these inefficiencies. Consequently, the effectiveness of the tendering system is often compromised, with negative implications for project delivery and the attainment of public policy objectives.
Technological advancements have the potential to enhance the efficiency and transparency of tendering procedures. Electronic procurement systems, also known as e-procurement platforms, are designed to reduce human intervention, facilitate faster bid submission, and expand access to tender opportunities. According to OECD (2016), the adoption of digital tendering tools enhances accountability by providing audit trails, reducing errors, and limiting opportunities for manipulation. However, it is asserted that the success of e-procurement systems depends on the availability of technological infrastructure, the skill level of personnel, and institutional commitment to adhere to digital processes. In many developing countries, inadequate technological capacity and resistance to change continue to hinder the full realization of these benefits.
Corruption risks within tendering processes have also been widely documented. According to Transparency International (2022), ineffective monitoring, weak enforcement of procurement regulations, and lack of transparency contribute to opportunities for corrupt practices. It is affirmed that such risks are particularly pronounced in environments where institutional controls are weak, and political influence is pervasive. The tendency for procurement decisions to be influenced by personal interests rather than merit undermines public confidence and reduces the perceived legitimacy of government procurement activities. This study is set against the backdrop of the need to examine the effectiveness of tendering systems in public sector procurement, identify the challenges that hinder optimal performance, and provide insights into strategies for enhancing transparency, competition, and accountability in the management of public resources.
1.3 Statement of Problems
Investigation revealed that there is no transparency and fairness in the award of contracts. Although competitive bidding is required by law, there are allegations of favoritism, political interference, bid manipulation, and limited access to procurement information. Such practices undermine open competition and reduce public confidence in government procurement activities. The absence of full compliance with procurement guidelines is associated with inflated contract costs, poor project delivery, and abandonment of projects (Thai, 2009).
In addition, delays in the tendering process constitute a significant challenge. Lengthy bureaucratic procedures, inadequate documentation, and slow approval mechanisms often result in prolonged procurement cycles (World Bank, 2016). According to Transparency International (2022), weaknesses in public procurement systems are closely linked to corruption risks, especially where institutional controls are ineffective.
Furthermore, there is the problem of inadequate competition among bidders. In some cases, tender opportunities are not widely advertised, or bidding requirements are structured in a way that favors certain contractors (OECD, 2016). It is against this backdrop that this study seeks to evaluate the tendering system in public sector procurement in order to identify its strengths, weaknesses, and areas requiring improvement.
1.4 Aim and Objectives of Study
The aim of this study is to evaluate the effectiveness of the tendering system in public sector procurement and assess its impact on project delivery and accountability.
The specific objectives of the study are:
- To examine the existing tendering procedures and determine their effectiveness in public sector procurement.
- To identify challenges and inefficiencies in the current tendering system.
- To assess the level of transparency, fairness, and competitiveness in tendering processes.
- To evaluate the role of technological tools, such as e-procurement, in improving tendering efficiency.
- To provide practical recommendations for enhancing the efficiency and accountability of the tendering system.
1.5 Research Questions
Based on the stated objectives, the research seeks to answer the following questions:
- How effective are the existing tendering procedures in public sector procurement?
- What are the challenges and inefficiencies associated with the current tendering system?
- How transparent, fair, and competitive are tendering processes in public sector procurement?
- What role do technological tools such as e-procurement play in improving tendering efficiency?
- What strategies can be implemented to improve the effectiveness, accountability, and efficiency of the tendering system?
1.6 Research Hypothesis
In order to pursue the objective of this study, the following generalized statements have been designed to guide and aids in obtaining the result for the experiment to be conducted. For this work, the null hypothesis will be represented with H0 while the alternative hypothesis will be represented with hypothesis H1.
Hypothesis One
- H0: There is no significant relationship between the effectiveness of the tendering system and the efficiency of project delivery in public sector procurement.
- H1: There is a significant relationship between the effectiveness of the tendering system and the efficiency of project delivery in public sector procurement.
1.7 Significance of Study
The outcome of this research will provide guidance on improving procurement policies and enforcing compliance with tendering procedures. The research will also identify procedural gaps and areas for professional capacity building.
Furthermore, the study will inform stakeholders on the requirements and expectations of public sector procurement, encouraging fair competition. In addition, the study will enhance transparency and accountability, ensuring that public funds are used efficiently and projects are delivered effectively.
Lastly, the findings will contribute to the literature on public procurement and tendering systems in Nigeria and other developing countries.
1.8 Scope of Study
The scope of this research is focused on the tendering system within public sector procurement in Lagos State, specifically analyzing procurement activities of selected government ministries and agencies.
1.9 Limitations of the Study
During the course of this study, there were some problems encountered which stood as limitations to the research work. Some of the limitations include:
- Time Constraint: The time frame given to accomplish this project was very short due to school academic calendar and it was carried out under pressure which made the researcher not to implement some necessary features.
- Financial Constraint: Insufficient fund tends to impede the efficiency of the researcher in sourcing for the relevant materials, literature or information and in the process of data collection (internet, questionnaire and interview).
- Initial Cooperation Delay from Respondents: A particular limitation of this work came as a result of the respondent refusal to offer their cooperation at the initial time they were contacted. This contributed in making the success of this research study difficult.
1.10 Definition of Terms
Tendering:
According to Thai (2009), tendering is a formal competitive process by which public institutions invite bids for the supply of goods, services, or works, aiming to ensure fairness, transparency, and value for money.
Public Sector Procurement:
World Bank (2016) stated that public sector procurement is the process by which government agencies acquire goods, services, or works using public funds, guided by policies and legal frameworks to achieve efficiency and accountability.
Transparency:
OECD (2016) defined transparency as the availability of clear and accessible information on procurement procedures, decisions, and results to all relevant stakeholders.
Accountability:
According to Transparency International (2022), accountability refers to the responsibility of public institutions to justify procurement decisions, ensuring ethical conduct and proper use of resources.
E-Procurement:
Reported by OECD (2016) as the use of electronic systems and platforms to manage procurement processes, including advertising tenders, submitting bids, and evaluating proposals to enhance efficiency and reduce human interference.
